IP & Takedown Policy

1. Purpose
COZQ Limited ("we", "us", "our") respects intellectual property rights. This policy describes how we handle reports of intellectual property infringement and takedown requests for content on the WHMDC Marketplace.
2. Intellectual Property Compliance
2.1 Developers listing Items on the Marketplace warrant that they have the right to distribute their work and that it does not infringe any third-party intellectual property rights.
2.2 Items must not:
- Copy or substantially replicate another party's copyrighted work without permission
- Use trademarks, logos, or branding without authorisation
- Include open-source components in violation of their licences
- Contain pirated, nulled, or cracked software
3. Reporting Infringement
If you believe an Item on the Marketplace infringes your intellectual property rights, please submit a takedown notice containing:
3.1 Your contact information (name, address, email, phone)
3.2 Identification of the copyrighted work or trademark you claim is infringed
3.3 Identification of the allegedly infringing Item (name, URL, item ID)
3.4 A statement that you have a good-faith belief that use of the material is not authorised by the rights holder
3.5 A statement that the information in the notice is accurate and that you are authorised to act on behalf of the rights holder
3.6 Your physical or electronic signature
Send notices to the designated contact address provided on the Marketplace website.
4. Takedown Process
4.1 Upon receipt of a valid takedown notice, we will:
- Acknowledge receipt within 2 business days
- Review the notice for completeness and validity
- Notify the developer of the Item
- Remove or disable access to the Item if the notice appears valid, typically within 5 business days
4.2 We may request additional information to verify the claim before taking action.
4.3 In cases of clear or repeat infringement, we may suspend the developer's account.
5. Counter-Notice (Developer Response)
5.1 If a developer believes their Item was wrongly removed, they may submit a counter-notice containing:
- Their contact information
- Identification of the removed Item
- A statement under penalty of perjury that the Item was removed due to mistake or misidentification
- Consent to jurisdiction of the relevant courts
- Their physical or electronic signature
5.2 Upon receipt of a valid counter-notice, we will forward it to the original complainant. If the complainant does not file a court action within 10-14 business days (as required by applicable law), we may restore the Item.
6. Repeat Infringers
Developers who receive multiple valid takedown notices may have their accounts permanently suspended and their Items removed from the Marketplace.
7. Misrepresentation
Filing a false or fraudulent takedown or counter-notice may result in liability for damages, including costs and legal fees. We may take action against users who abuse this process.
8. DMCA and UK/EU Compliance
8.1 For users in the United States, we comply with the Digital Millennium Copyright Act (DMCA) safe harbour provisions.
8.2 For users in the UK and EU, we comply with the E-Commerce Directive and applicable national legislation regarding intermediary liability.
9. Appeals
If you believe a takedown decision was incorrect, you may appeal by contacting us with additional evidence or clarification. We will review appeals on a case-by-case basis.
